As a result of the passage of S.B.
875 in the 1997 Texas Legislature, all information collected under
Chapter 62, Code of Criminal Procedure on sex offenders, who are
under supervision or incarcerated as of September 1, 1997, is now
considered public information. Under Article 62.08 of the amended
legislation, entitled CENTRAL DATABASE; PUBLIC INFORMATION, the
Texas Department of Public Safety is charged with maintaining a
computerized central database containing only the information
required for registration under this chapter. The information
contained in the database is public information, with exception
of: An offenders social security number, drivers license number,
any information that would identify the victim of the offense for
which registration is required, or any information that is
required by the department (i.e, blood type, vehicle, occupation,
employer, next of kin, etc.).
According to the statute, the release of the information described
above may be provided only upon a written request to a local law
enforcement authority. The authority may charge a fee to cover the
administrative costs associated with the authority's release of
information subject to the written request.
Information that is now considered to be "PUBLIC
INFORMATION" is only that information collected subsequent to
the amended 1997 legislative changes. This means ALL registration
information on offenders who are under supervision or incarcerated
as of September 1, 1997 for reportable convictions or
adjudications occurring on or after September 1, 1970 is public
information.
If an offender was discharged from supervision or correctional
custody prior to September 1, 1997, they are no longer required to
register and their previous registration information IS NOT
PUBLIC.

report by e-mailing the Records
Department or by coming by the police department during
regular business hours. A local law enforcement authority
may not release any information beyond that which is contained in
this report.
